Theo Stoller is an agent of the German Federal Intelligence Service who had been working covertly with government permission in the United States of America.

Theo was trained by MI6. Six months prior to the events that took place in Day 5, Theo Stoller came to the United States to take part in a covert operation. He built a romantic relationship with information broker Collette Stenger to gather intelligence on her terrorist clients around the world.

During Day 5, Theo Stoller was in a hotel room with Collette Stenger, who was brokering a deal for Russian separatist Vladimir Bierko. When Theo insisted on knowing about Stenger's work, in order for him to help her in some way, Collette became angered and insisted she doesn't talk about her work. He diverted her attention by announcing news from Maria, their real estate agent, concerning a villa in Positano.

Stenger leaves the hotel in order to meet with her client, and she tells Theo she will meet him at the Van Nuys Airport. After leaving Collette leaves the hotel, Theo leaves and discovers armed men storming the hotel. When the armed men treat Theo as a hostile, Theo threatens to shoot Curtis Manning if the agents don't stand down.

Theo reveals his identity to Curtis Manning and Jack Bauer.

After it is confirmed that the armed men are with CTU Los Angeles, Stoller reveals that he is an operative for German Intelligence. When Jack Bauer revealed that Stenger is working with a known terrorist, who is planning to strike America within the next few hours, Theo refuses to cooperate. He has been building his case for months and giving up Stenger will just blow up the operation.

When Bauer offers to get the WET List for Theo, he agrees to give up Stenger. Stoller's agency has been wanting the list for some time, but the American government refused to give it up. After Chloe O'Brian sent the list to Jack's PDA, Stoller started to cooperate and told Jack where he was meeting with Stenger.

When Bill Buchanan and Karen Hayes demand for Jack to get the WET list back, Stoller pulls a gun on him. After Jack tells Karen that there is no other way to stop the next attack, Stoller realized he wouldn't be double-crossed. When Stenger arrives, Stoller stalls her in order for CTU to identify her. After Stenger is taking into custody, Stoller drives away.

Theo calls his German contact, and asks him to inform his superior, Heinrich, that he now has something Heinrich has wanted for a long time. While uploading the WET list to his superiors, the memory card catches fire inside his PDA, destroying it. When Jack calls Theo, he apologizes and promises to help him rebuild his case once the national security crisis is over. Theo refuses and angrily hangs up the phone.
